Colbert Goes to Washington

Colbert testifies before the House Judiciary Committee. Prior to this, Chairman John Conyers Jr., (D-MI) wanted Colbert to leave because of the number of press present. Does not the Chair control how many and who is in the chamber? He could have picked and chosen who could cover the show.

"The newspaper Reforma, citing a police report, said that that the migrants were trying to reach the U.S. border and were killed when they refused to pay extortion fees demanded by the armed group. Reforma said the survivor was from Ecuador. The federal officials could not immediately confirm those details."

Virginia legal opinion supports checks of immigration status

"Our opinion basically said that Virginia law enforcement has the authority to make such inquiries so long as they don't extend the duration of a stop by any significant degree,'' Cuccinelli (R) said at a news conference Monday. "That's consistent with Supreme Court authority."
The attorney general issued the opinion in response to a request from Del. Robert G. Marshall (R-Prince William), who sought clarification on whether local police, conservation officers and zoning officials could inquire about legal status.
Again, it is not randon stops to check documentation.

An Abominable Decision - Mark R. Levin - The Corner on National Review Online



This is a typical example of a judge stating the correct legal standard, but then ignoring it and applying the test in a fashion completely divorced from the facts of the case in order to reach a predetermined decision.

First, the court states correctly that the sort of constitutional challenge brought here — a facial challenge — is the most difficult challenge to mount successfully. It requires that the plaintiff (here the federal government) must demonstrate that the law can never be applied in a constitutional fashion. The test cannot be met with hypothetical arguments — yet that is exactly what the court relies on in its ruling: the assertion that the AZ law will impose an impermissible burden on law enforcement, which is to determine the legal status of a person detained pursuant to the AZ law on the reasonable suspicion that the person is in the country illegally. The court does not provide any empirical basis to support its conclusion. It’s pure supposition.
