Appeals court: Stolen Valor Act unconstitutional - Yahoo! News
"PASADENA, Calif. – A three-year-old federal law that makes it a crime to falsely claim to have received a medal from the U.S. military is unconstitutional, an appeals court panel in California ruled Tuesday.At least this panel from the 9th had one member with some sense. Too bad it was only one.
The decision involves the case of Xavier Alvarez of Pomona, Calif., a water district board member who said at a public meeting in 2007 that he was a retired Marine who received the Medal of Honor, the nation's highest military decoration.
Alvarez was indicted in 2007. He pleaded guilty on condition that he be allowed to appeal on First Amendment grounds. He was sentenced under the Stolen Valor Act to more than 400 hours of community service at a veterans hospital and fined $5,000.
A panel of the 9th U.S. Circuit Court of Appeals sided with him in a 2-1 decision Tuesday, agreeing that the law was a violation of his free-speech rights. The majority said there's no evidence that such lies harm anybody, and there's no compelling reason for the government to ban such lies.
The dissenting justice insisted that the majority refused to follow clear Supreme Court precedent that false statements of fact are not entitled to First Amendment protection."
The only series tie-in here is that neither John, nor his son Tag, talk much about their awards. There is slight mention in Suki III that John tended to put his fellow Soldiers in for awards while he never sought them.

NEW YORK — A right-wing New Jersey blogger was convicted at his third trial Friday of making threats against three federal judges in Illinois in retaliation for a ruling supporting gun control.
A Brooklyn jury deliberated less than two hours before finding Hal Turner guilty of making death threats.
A judge jailed Turner, of North Bergen, N.J., following the verdict. His attorney declined comment.
Patrick J. Fitzgerald, the U.S. attorney for the Northern District of Illinois, thanked the jurors for their service.
'There is no place in society for threatening federal judges with violence. Period,' he said in a statement. 'We are grateful that the jury saw these threats for what they were and rejected any notion that they were acceptable speech.'
Series tie-in: In the 2030s the right of Americans to keep and bear arms is settled law. Written and voiced threats are taken seriously too, as well as actions in furtherance of the threat.
Authorities said he crossed the line by writing: "Let me be the first to say this plainly: These judges must die. Their blood will replenish the tree of liberty."
